Simulated rape porn provides an outlet for those with a pathological need to watch it. If that outlet is closed, the need will go unsatisfied and will build to a breaking point. This breaking point may manifest itself as an uncontrollable urge to rapeā€¦or worse.
No one is going to complain or get into trouble if consenting adults want to produce a simulated rape porn video within the privacy of their own home.

However, if it's being produced and sold then it falls under the metric of the law.
So in order for it to be considered protected by the legal precipts of Freedom of speech and/or expression it must be :
  • 1) An opinion
    2) An idea
    3) Information

And regardless of the medium used or the chanel of distribution the "Opinion and/or Idea and/or information there is a legal onus of responsiblity that must be observed.

Therefore legally the Opinion and/or Idea and/or Information must not:
  • 1) Infringe rights or reputation of others
    2) Risk or cause problems to the protection of national security or the public order
    3) Risk or cause problems to public health and morals.

Finally as for being an outlet for some "pathelogical need" in order to avoid actually raping someone, I'm not finding a single study confirming it. (sorry)

Whereas there are numerous studies that confirm that watching even simulated violence cause the viewer to become desensitized to violence. Furthermore in some cases it instills a desire in the viewer to act out their violent fantasies. (NB. I'm not distingushing a difference between Hollywood movie based simulated voilence or porn simulated violence.... Sexual or non-sexual)

That's a blog entry and not a study.

However I did some digging and I manage to find the study that the blog article attempts to talk about. So I rolled my up shirt sleeves and did some academic analysis of it. First of all here's where you can find the orginal study :

Second here's the analysis of the actual study that you tried to cite.

This paper was done by simply comparing the number of reported incidents for sexually related crimes before and after the ban on pornography was lifted. There is no study done of the prevailing or changing societal attitudes towards such crimes during this, over 30 year, period. Such a study would have given better insight into the reasons for the changes in crime reporting that occured.

The most erratic changes occured in the reporting of lesser sex crimes. The prevailing attitude prior to the lifting the ban towards sexuality was severe;
"Police and court actions would even judge nude pictures as social ills and impose punishments. The criteria for determining the materials illegality was not specifically stipulated." So the initial decline could have been simply a reaction of uncertainty if an "act" merited report; ie: would it be considered a crime. This would account for the otherwise inexplicable spike that came a few years after. The final decline in reports shows an overall change in societal attitude towards this crime.

Most significant findings are that the number of reported cases of child sex abuse immediately dropped markedly after SEM was legalized, but the reported cases of rape during this time spiked. And the incidence of reported child sex abuse,increased again for a few years to peak in 1995 and 1998. While the reported incidences of rape returned to its frequency seen during the period under communism: between about 500 to 750 cases a year.

All in all, violent crime in the Czech Republic has seen signifigant increase, while the incidence of reporting severe sex crimes has seen very little change. Obviously societal attitudes have transformed, but to conclude that that internet porn "helps" lower sex-crimes based on this report, is simply ridiculas.
