Photo of 90 y.o. man is not to be used in memes, says judge in South America.

First case of meme persecution (and prosecution), the old photo of a "gaúcho" (cowboy) man now on his 90's, a judge ordered the removal from all images from the page "te sento a vara" - roughly tranlated as "give you the club" and usually meant as "I'll lash thee" but also "I'll slap/bang you with the stick".

It was found the page owner was facilitating posting of memes, derogatory comments, and even planning on selling t-shirts and mugs with the old man fotos. A US $25,000 payment to the "involuntary model" was ordered, although the web profiteer said he "was under impression the picture he found circulationg the web was of public domain nature". Oh yes, everything people copy and paste should probably be public domain if it is not found on a comercial site... until you make it a business.

Now this guy was trying to make some bucks from someone else's face without any attempt to find the person behind the photo, reparations are just; but taking out the memes seems like too much, since they don't directly offend said man, actually they (mostly) use him as a refence for a "macho man", serious hard ass cowboy.

The IP issues are getting insane. I take the Stallman stand here. If you post it on the net, it is for all to 'share'. You cannot steal an infinitely reproducible resource. Improper attribution should be met with social censure.
