Who gets prosecuted?

I have seen that many people who upload copyrighted material to torrents are never caught.

Some who get caught are the ones who upload new movies and bunch of songs but I have never heard of persons getting caught for uploading small PC softwares or games. Is it true?

One of my early college friend uploaded a movie editing (payware) software to tpb without any VPN some 4 years ago and is still not sued. How can it be possible? Is there any chance that he will still be prosecuted? And even if yes, how are they gonna sue him?

Yes, it's true, because software companies generally use different methods to discourage piracy--primarily withholding of support and updates from non-registered users.

he means that no one is likely to care too much to find out who did what four years ago.

It depends on where your pal uploads the software from.

Different parts of the world deal with piracy in different ways.
