The real deal is that downloading any given content is unlikely to net you any kind of warning, in most countries (UK may very well be nastier), as long as you haven't seeded at 100% (in other words, a "full" seed, as opposed to uploading while you download). This is because you can easily say, "Oh, I thought it was legal, but deleted it as soon as I realized it wasn't" successfully, among other reasons. Once you have 100%, however, and are directly seeding, you are now officially "distributing" w/e content.
*shrug* It is what it is. What this means for many people is that, for likely-enforced content (new music, movies and TV series, especially off of paid networks like HBO), "hit-and-run" is the order of the day, UNLESS you have a VPN and/or a good (offshore) seedbox. Or if you happen to live in the right legal environment ^^' .
