It is baseless fear because until you response to the letter they have nothing on you. Ignore it and they can't do anything.

Similar to getting pulled over for speeding. If you don't admit to the cop when they come to your door you can get out of it most of the time. However if you say anything to them that involves admitting you were speeding it makes the court case for it makes it alot harder to get dropped.

Well some people have said it's only in the USA that this is happening and others have said worldwide, Hard to know who has the facts

No, because this is not different than any previous attempt to go after downloaders.

If you're afraid, look up the Hurtlocker cases. I'm pretty sure only a handful got caught.

Why It's Getting Harder to Sue Illegal Movie Downloaders


These days they are skipping the trials and going right to settlements. What they are counting on is that people don't realize that those offering the settlement have no idea who the downloader is. All they have is an IP address, which is meaningless. They send the notice to the owner of the IP address (likely your ISP) who then forwards it on to you. If you ignore it, they have no choice but to move on or spend a lot of resources trying to convince a court to force the ISP to reveal the account holder's personal information - which only tells them who to sue.

They fill the notice with a lot of threats hoping it will scare someone enough to respond. What they don't say is that it will cost them a lot of money to follow through with those threats. Enough so it is highly unlikely they ever will.


Bottom line - if you ever receive one of those notices DO NOT RESPOND. Set it aside and talk to some people you trust to figure out what it really means. Do some research. Because if you respond, they will now know who you are and it will make things a lot harder. It is still on them to prove infringement, but you'll now be forced to defend yourself along the way.
