I have had my tracker up in Sudan for a while, but the provider there is a bit shaky and the service stability isn't the best lol.
I was reading up on countries blocking major torrent websites, as well as where BREIN's "takedown" plan limits itself.
I considered a South American country, and American or European copyright claims isn't my biggest concern since my website is a private tracker for Asian torrents.
But as of right now, I am using a hidden template as a cover, and you have to be signed on to even see its true layout, which doesn't say much to potential new users, and I like a safe haven for smaller sized tracker.

I heard that in Romania, things are doing fine. But I can't think at a hosting company there...

Does your Site comply with with DMCA Take down Notices or No....????....If Yes then there are many options.

On the outside, yes-
My tracker is very small compared to most (200 members / 1,480 torrents).
Due to our strict security, nothing has ended up in the wrong hands yet. To be honest, It'd all depend on my mood, I hate these fucking people.

I presume by "tracker" you really mean "index" as running an actual torrent tracker is generally a waste of time and money.
One has to consider more than just the country the physical data center is located in. Consider where the business you are renting the server from operates from (which is usually not the same country as the data center), as well as your registrar and the issuer of your SSL certificate (if any). Those are all points from which your site can be taken offline.
Anyways, eastern European/Russia is probably the best combination of stability, performance, and not giving too many fucks.

Moved again, server is in the EU and the providers are Indian.
All of the files are stored on the server, so it'd be a huge smack if I do get caught, but my current provider doesn't give a damn as he gave me help modifying it knowing fully well what it was.
I will keep my current one for a while, as he said if I comply with DMCA they won't bother taking me offline and they have servers in Ukraine and Greece.
If you have any other pointers I should know about, I'd soak up every advice you feed me.

If all you are truly doing is running a torrent index, then there are no files to host. All you need is a database with a decent search engine and magnet links to initiate the download process. If you must link to a torrent file, then use a 3rd party to host them. Most have an API that let you pass the torrent file on to them at the conclusion of the upload process.
It really shouldn't make a difference hosting them or not, but it is one less piece of liability if that worries you.

It's a tracker and I haven't enabled magnets so far, just normal torrents. I am considering doing it to save some space though, but I have some complications with my current setup that I need to fix before going there.
And I am not too worried about myself, considering the country I live in, at worst, I'd do 2-3 months. More worried about members information getting leaked like situations on KAT, as I am pretty sure most of them don't follow the VPN suggestions.
I usually pay attention to torrent news, and how copyright companies go after regular users now if the owner is hidden or the provider doesn't want to give up info. And I rather ask dumb questions here and learn a thing or two than to have my users jacked.
I haven't received any notices yet but recently the "guest" activity and amount of random applications have put me on edge.
But is there an easy way to move from being a tracker to an index? If I enable magnets, it could reduce leakage of torrents, but I can't find any good info on it and I just recently built this site, but the membership grew faster than I had anticipated, with around 30-40 new members on a daily basis and growing I just went over to applications.

Kazakhstan.
Trackers such as kaztorka.org and megatorrents.kz are working here for a long time.
You can try Russia, but largest torrent rutracker was blocked not so long ago
